Category:ParodiesIn a recent court decision upholding the previous practice of US carriers, a judge ordered in the class action lawsuit challenging internet “data-roaming” – that US carriers should charge the same amount as local carriers for data sent outside the US. Verizon’s CEO has said that the company is evaluating the decision.
Verizon, AT&T, Sprint, and T-Mobile, were sued in 2012 by the New York Attorney General, claiming that US carriers were charging exorbitant data roaming fees when consumers traveled outside the United States. The suit sought to force the companies to treat data sent over their networks as they would if the data was sent within the country.
In a 4-3 ruling, the US Court of Appeals for the Second Circuit overturned the district court decision ordering the companies to abide by the lower rates, citing the Foreign Trade Antitrust Improvements Act of 1982. That case, brought on by ATT, resulted in a financial settlement with the Department of Justice.
The decision upheld that carriers “may not charge different rates or impose different obligations on wholesale data traffic between the United States and foreign countries, or on traffic in international transit through the United States.”
Verizon CEO Lowell McAdam was quoted in the Financial Times, calling the ruling “unfortunate.” “If we’re required to charge the same, we will,” McAdam said.
